Every person who visits our Website and/or relies on our services (hereafter the “Data Subject” and “you”) will almost inevitably disclose a certain amount of personal data. The personal data is information which allows KLIUM to identify you as a natural person, regardless of whether we actually do this. You are identifiable as soon as it is possible to create a direct or indirect link between one or more data and you as a natural person.

2. Who is responsible for the processing of your personal data?

2.1. Controller

KLIUM is responsible for the processing of your personal data and decides alone or in cooperation with others which personal data are being collected as well as the purposes and the technical and organisational means with regard to the processing of those personal data. As a consequence, KLIUM is a data controller within the meaning of the GDPR.

KLIUM is free to rely on data processors. A data processor is a natural or legal person who processes personal data upon request and on behalf of the data controller. The data processor is required to ensure the security and confidentiality of the personal data. The data processor shall always act on the instructions of the data controller.

KLIUM relies on the following categories of "processors":

3. On what legal grounds are my data processed?

In accordance with the GDPR we process personal data on the following legal grounds:

  • On the basis of the execution of the contract agreed upon with you or the execution of pre-contractual steps taken at your request; or
  • On the basis of compliance with legal or regulatory provisions with regard to the management of the contractual relationship, invoicing in particular;
  • On the basis of our legitimate interest in sending information and newsletters to our customers;

4. Which personal data are being processed?

KLIUM commits to only collect and process adequate, relevant and limited to what is necessary for the purposes for which they are processed. The following categories of personal data are processed by KLIUM:

  • Financial identification data (bank details)

5. For which purposes are your personal data being used?

KLIUM collects your personal data for the sole purpose of offering every Data Subject a safe, optimised and personal user experience of our Website and our services. The collection of personal data becomes more extensive as the Data Subject makes more intensive use of our Website and our services. KLIUM reserves the right to suspend or cancel certain operations if certain personal data is missing, incorrect or incomplete.

The processing of your personal data is essential for the proper functioning of the Website and the provision of the associated services. KLIUM commits to solely process your personal data for the following purposes:

7. How long do we store your personal data?

Your personal data is stored as long as necessary to achieve the purposes pursued. The personal data will be erased from our database as soon as it is no longer necessary for the purposes pursued or if you validly exercise your right to erasure.

8. What are my rights?

8.1 Guarantee of a legitimate and secure process of your personal data

Your personal data are always processed for the legitimate purposes explained in point 5. They are collected and processed in an appropriate, relevant and non-excessive manner, and are not kept longer than necessary to achieve the intended purposes.

KLIUM has taken sufficient technical and organizational security measures to guarantee the safe processing of personal data. These security measures are proportional to the nature of the personal data and the potential risks.

The risks of accidental or unauthorized destruction, accidental loss, modification of or access to, and any other unauthorized processing are therefore reduced to a minimum. Unfortunately, this does not mean that there is no longer any risk. In the event of a breach in the IT systems, KLIUM will immediately take all possible measures to minimize damage and/or theft.

8.3 Right to rectification of your personal data

Inaccurate or incomplete personal data may be corrected. It is your responsibility to make the necessary changes in your "user area", but you can also request us in writing.
